Abstract
U ovom se radu opisuju slučajevi iz prakse, praktična pitanja vezana uz izvanredni otkaz poslodavca upućenog radniku. Radni odnos, koji se zasniva ugovorom o radu, može prestati samo na zakonom propisane načine. Otkaz, kao način prestanka radnog odnosa, može biti redoviti i izvanredan. Uvažavajući poslovni interes poslodavca i interes radnika, zakonodavac je predvidio mogućnost (izvanrednog) otkazivanja ugovora o radu bez poštivanja otkaznog roka, kada nastupe određene okolnosti zbog kojih ugovor o radu što su ga sklopili radnik i poslodavac više ne bi trebao egzistirati. Cilj ovog rada je objasniti temeljne pojmove otkaza ugovora o radu u Republici Hrvatskoj s naglaskom na izvanredni otkaz poslodavca radnika s osobitim naglaskom na praksu.
Abstract (english)
This thesis describes case studies, practical issues related to the extraordinary dismissal of an employer referred to an employee. Employment, which is based on a contract of employment, can only be terminated in the manner prescribed by law. Termination, as a way of termination of employment, can be regular and extraordinary. Taking into account the business interest of the employer and the interest of the worker, the legislator envisaged the possibility of (extraordinary) termination of the employment contract without observing the notice period, when certain circumstances arise which make the employment contract concluded by the worker and employer no longer exist. The aim of this thesis is to explain the basic concepts of termination of an employment contract in the Republic of Croatia with an emphasis on extraordinary dismissal of an employer of workers with particular emphasis on practice.
