Abstract
U praksi se javljaju problemi u svezi s razgraničenjem između redovitog otkaza uvjetovanog skrivljenim ponašanjem radnika i izvanrednog otkaza zbog takvog ponašanja, te ću u ovom završnom radu pokušati prikazati kroz zakonsku osnovu i sudsku praksu kako prepoznati da se radi o redovnom otkazu uvjetovanom skrivljenim ponašanjem radnika, a ne izvanrednom. Nadalje ću se fokusirati na redovan otkaz uvjetovan skrivljenim ponašanjem radnika, treba li upozoriti radnika na ponašanje, te navesti koji su opravdani, a koji neopravdani razlozi za takvu vrstu otkaza.
Abstract (english)
In practice, there are problems related to the demarcation between regular dismissal due to the hidden behavior of the worker and extraordinary dismissal due to such behavior, and in this final paper I will try to show through the legal basis and judicial practice how to recognize that it is a regular dismissal due to the hidden behavior of the worker, and not extraordinary. Furthermore, I will focus on the regular dismissal due to the hidden behavior of the worker, whether the worker should be warned about the behavior, and indicate which are justified and which are unjustified reasons for this type of dismissal.
