Abstract Ovrha na nekretnini, koja uistinu teško pogađa ovršenika, određena je brojnim složenim pravnim, socijalnim i financijskim odnosima, s kojima se isprepleću trajni ciljevi koji se u ovršnom postupku za sada samo nastoje ostvariti. Neki od njih su brzina, transparentnost, djelotvornost, pojeftinjenje, jednostavnost. Ovrha na nekretnini provodi se zabilježbom ovrhe u zemljišnoj knjizi, utvrđenjem vrijednosti nekretnine, prodajom nekretnine i namirenjem ovrhovoditelja iz iznosa dobivenoga prodajom. Nakon provedbe postupka za utvrđivanje vrijednosti nekretnine sud donosi zaključak o prodaji nekretnine kojim se utvrđuje vrijednost
nekretnine i određuju način i uvjeti prodaje, a samu prodaju nekretnine provodi Financijska agencija (Fina), dok zahtjev za prodaju Fini dostavlja sud, koji pritom dostavlja rješenje o ovrsi, izvadak iz zemljišne knjige i zaključak o prodaji. Prodaja nekretnine obavlja se elektroničkom javnom dražbom. Ako je dražba bila uspješna, sud pristupa namirenju vjerovnika nakon pravomoćnosti rješenja o dosudi nekretnine kupcu i nakon što kupac položi kupovinu. U radu su opisani i sam tijek provođenja ovrhe na nekretnini, odnosno određivanje vrijednosti nekretnine, zatim prodaja nekretnine, namirenje vjerovnika te održavanje ročišta za diobu, kao i iseljenje ovršenika.
Abstract (english) Enforcement on real estate, which really hits the debtor hard, is determined by a number of complex legal, social and financial relations, with which the permanent goals are intertwined, which in the enforcement proceedings are only trying to be achieved for now. Some of them are speed, transparency, efficiency, cheapening, simplicity. Enforcement on real estate is carried out by recording the enforcement in the land register, determining the value of the real estate, selling the real estate and settling the bailiff from the amount obtained from the sale. After the procedure for determining the value of real estate, the court issues a conclusion on the sale of real estate which determines the value of real estate and determines the manner and conditions of sale, and the sale of real estate is carried out by the Fina, while the request for sale to the Fina is submitted by the court books and a conclusion on the sale. The sale of real estate is done by electronic public auction. If the auction was successful, the court proceeds to settle the creditor after the decision on the award of the real estate to the buyer becomes final and after the buyer has deposited the purchase price. The paper describes the course of enforcement on real estate, is determining the value of real estate, then selling real estate, settling creditors and holding hearings for division, as well as the eviction of the debtor.
